Interpretation
“Company” means Hestia & Hearth whose registered office is Byre Cottage, Tapster Lane, Lapworth, Warwickshire, B94 5PQ. “Customer” Means the individual, firm, company or other party with whom the company contracts; “We/Us/Our” Means Hestia & Hearth. “Contract” means a contract for the purchase and sale of goods; “Goods” Means any goods and any instalment of the goods or any parts for them which the Company has agreed to supply under the Contract;
Goods, Pricing and Availability
Every product bought is sold subject to its product description. We always strive to ensure that all the product details, prices and descriptions on our website or in any marketing material are accurate at the time of entering them into our systems or printing our materials. In the event that the website does not reflect the position exactly at the point an order is placed, we will try to correct any mistakes as quickly as possible and inform the Customer of them so that you may either confirm your purchase or cancel your order.
We try as much as possible to ensure web pictures truly reflect the product’s colours but sometimes you may see a colour variation in the products from how they appeared on your screen due to factors such as monitor settings and/or photographic lighting used. Please note some of our products are hand-made and hence open to variations from the picture seen on our website and other items made within the order. We however believe that the uniqueness is the beauty and appeal of hand-made products.
Please be aware of any product care instructions included within the product descriptions on our website. We cannot be held responsible for any goods that have been damaged as a result of not being cared for as per our guidelines and recommendations and therefore will not be able to issue a refund or replacement.
Please note that we are unable to confirm the price of a product until your order is accepted in line with our order acceptance conditions. Price Adjustment Policy, We are unable to offer a price adjustment on items originally purchased prior to them going in a sale and once an item has been purchased in a sale, no price adjustment will be offered should the item be reduced in price further.
Payment
Please be aware that you will be charged for the whole value of your order as soon as you place it, not after you have received the goods. This is also the case for items which are not yet in stock and you pre-order.
Deliveries
We endeavor to use a reliable and efficient delivery service and as such, the logistics company we work with will use a considered selection of couriers. The courier selected for each delivery will depend on size, weight and number of parcels and the delivery time you have selected. Delivery charges will vary depending on the service you select and are subject to change depending on the size and weight of your parcel. Should there be a change, our customer services department will contact you prior to delivery to confirm you would still like to proceed with your purchase. Before you submit your order please ensure you have entered the correct delivery address details as any errors could result in additional delivery charges.
Important Information: For next working day delivery and next working day AM, the order must be placed by 12pm the previous working day. Only Monday to Fridays are classed as working days. If a next day delivery order is placed after 12pm on a Friday, it will not be despatched until the Monday, with the exception of Bank Holidays. During the order process you can request that the parcel is left with a neighbour or in a safe place. Please ensure that you check all items on receipt, as faulty or damaged items must be reported within 7 working days of receiving the parcel.
Our delivery charges quoted will apply to Mainland UK only. Different prices will be charged for deliveries to the Isle of Wight, Isle of Scilly, Northern Ireland, Dublin, Highlands and Islands. All prices quoted and charged are in Great British Sterling (GBP) and include the 20% UK VAT (Value Added Tax). If the delivery destination is the Channel Islands, the VAT will automatically be changed to 0 and you will not pay for the UK VAT.
Risk & Ownership
Risk of Goods (responsibility of Goods) is transferred at the point of delivery; Ownership of Goods is transferred once Goods are paid in full and delivery has taken place.
Fault, damaged or incorrect Goods
For any faulty or damaged Goods, please take a photo and email us within 24 hours of receiving the goods at store@hestiaandhearth.com Please do not simply return damaged or faulty Goods without contacting us first. For incorrect Goods please contact the Company within 24 hrs of receiving the Goods.
Cancelling and Returning Goods
Returns, We hope that you are delighted with the goods you have purchased from Hestia & Hearth, however, in the event of any disappoint, you have 14 days in which to return an item. You are responsible for the cost of returning your item(s) to us, unless you have received a faulty, damaged or wrongly despatched item. Please obtain proof of purchase when you do so.
Goods must be returned in their original packaging with the returns slip completed and included in the package. Please ensure you repack the goods carefully as we cannot be held responsible for any goods damaged on their way back to us. We will inspect the returned item and notify you of your refund or replacement via email. We try to process returns as soon as possible but please allow up to 14 days for us to do so, especially during busy periods. Force Majeure
In this clause “Force Majeure” means an overpowering force itself, which prevents the fulfilment of a contract. If the Company is affected by Force Majeure it shall promptly notify the other party of the nature and extent, and will not be liable to the customer and not deemed as in breach of these conditions.
Other Terms
These terms and conditions (“Terms”) apply to each purchase of goods made from our website www.hestiaandhearth.com by telephone 07399610378. These Terms also cover emails and any other promotional material such as catalogues. We may change or update these Terms occasionally and will publish changes on this website. By placing an order, the Customer agrees to be bound by these terms and conditions. If you do not agree with them you should refrain from placing an order with us. We would advise the user to check them regularly.
Law and Jurisdiction
The formation, performance, validity and all aspects of the Contract shall be governed by the laws of England and the parties submit to the non-exclusive jurisdiction of the English Courts.
